General Terms and Conditions
All goods remain the property of Top GPS until paid for in full. Prices, specifications and availability of products are subject to change without notice. Due to the volatile nature of the I.T. market, descriptions may not reflect current technical information. Any typographical, photographic, or specification error in product,
pricing or offers is subject to correction. Top GPS may change its pricing, product description or specification after any order confirmation but prior to dispatch of goods due to errors, changing market conditions, product discontinuation or typographical errors. Software is not included with systems unless specified. We reserve the right to limits sales, including the right to prohibit sales to re-sellers, business organisations or individuals. TopGPS is not VAT registered so published prices do include VAT. Published prices do not include delivery or insurance charges (see also below). Proof of purchase and postage may be required for refunds. To comply with certain reseller agreements and government regulations, Top GPS reserves the right to refuse to export products from the United Kingdom at any time. If you are purchasing products for export, you are responsible for the necessary export documentation before shipment is made to a foreign country. Manufacturer's warranties for exported products may vary or be null and void.
Demonstrations, Training, Delivery and Assistance with Installation
These free services are only available within a radius of 20 miles from Otley, West Yorkshire - unless otherwise stated. Prices for these services at other locations available on request.
Pricing Errors
Top GPS is not liable for pricing errors. If you place an order for a product that was incorrectly priced, we will cancel your order and credit you for any charges. In the event that we inadvertently ship an
order based on a pricing error, we will issue a revised invoice to you for the correct price and contact you to obtain your authorisation for the additional charge, or assist you with return of the product.
Money Back Guarantee
Money Back Guarantees are limited to specific products and must be documented on the invoice item to be valid. If you are not 100% satisfied with your purchase, you may receive a prompt replacement or refund subject to the Return Material Authorisation procedures documented below. Shipping and insurance charges are not refunded. In order to receive a refund, your purchase must be returned with carriage pre-paid. All items must be in "as new" condition, in original packaging and with all manuals, accessories and include the original invoice. Any discrepancies will result in forfeiture of your refund. A 20% restocking fee and carriage costs will not be refunded against any returned items. Refunds on purchases made with a credit card will only be credited to the same card.
Returns Policy
Unless otherwise documented on the invoice Top GPS will cover any second-user or refurbished items with a seven day repair or replace warranty and all new goods will be covered with a one year return to base warranty, both warranties are valid from date of invoice. All goods, other than software, returned within the products warranty period from date of invoice, with original receipt, are eligible for repair or replacement. Top GPS reserves the right to replace or repair any faulty products or components with either new or refurbished products dependent on requirements. Top GPS will not accept the return or exchange of any item if the Serial Label has been removed or broken. All Top GPS warranties and technical support will not cover any product, software or components that have not been directly purchased from Top GPS.

Any damage, fault or virus defecting the original Top GPS product occurring due to user modification, including component and software implementation not supplied by Top GPS will not be covered by any Top GPS warranty and Top GPS reserves the right to charge for any labour, parts and delivery charges incurred. Top GPS telephone support will only cover goods supplied by Top GPS and will not cover any enquiries relating to additional components or software purchased elsewhere.
Return Material Authorisation Procedure
Before returning any item you must call our Customer Service Department on within the warranty period of the goods purchased, valid from the date of invoice, for a Return Material Authorisation (RMA) number and form. RMAs are valid for five days from date of issue. The completed RMA form must be included within the packaging and the RMA number must appear on your return packing label. Please do not write on the outside of the box. Returns will not be accepted without an RMA. Any faults or damage that is not documented on the Top GPS RMA form that may have occurred due goods in transit will not be covered by the Top GPS Warranty documented above.
Ordering Information & Methods of Payment
Top GPS accept business cheques and BACS transfers direct to the Top GPS account. Any cancelled or returned cheques issued to Top GPS will be subject to a (10%) administration fee chargeable to the customer.
Privacy Policy
We are committed to protecting your privacy. We will only use the information that we collect about you lawfully (in accordance with the Data Protection Act 1998). We collect information about you for two reasons: firstly, to process your order and second, to provide you with the best possible service.
We will not e-mail you in the future unless you have given us your consent. We will give you the chance to refuse any marketing email from us or from another trader in the future. The type of information we will collect about you includes: your name, address, phone number, e-mail address, bank details. We will never collect sensitive information about you without your explicit consent. The information we hold will be accurate and up to date. You can check the information that we hold about you by emailing us. If you find any inaccuracies we will delete or correct it promptly. The personal information which we hold will be held securely in line with our internal security policy and the law.
Disclaimer of Warranty, Title to Goods, Trademarks
Top GPS hereby expressly disclaims all warranties either expressed or implied including any implied warranty of merchantability or fitness for a particular purpose. This disclaimer in no way affects the term of any manufacturer's warranty. The title to purchased goods is retained by Top GPS until goods are paid for by the purchaser in full. Top GPS reserves the right to repossess any goods that have not been paid for in full and invoice the customer for any legal, delivery and restocking costs incurred. All trademarks and logos published are the property of their respective companies.
No Consequential Damages
In no event shall Top GPS, its subsidiaries or affiliates, or their respective officers, directors, employees, representatives or agents (collectively, "Top GPS") be liable for special, incidental, consequential, punitive, indirect, or other special damages, including but not limited to, loss of data, use, or profits, however caused, whether for breach of contract, negligence, or otherwise, and whether or not Top GPS has been advised of the possibility of any such damages.
